Why Hire a Lawyer for the Board of Appeal?

In most cases, the Board of Appeal represents your last chance to overturn your license suspension or obtain a hardship license. This is usually your final chance to present the evidence and arguments necessary to win the appeal and not having a lawyer can be a big mistake. The RMV is represented by lawyers at these Board of Appeal hearings and you should have an attorney fighting for you. I get a large number of calls in inquiries from people who made the mistake of representing themselves and the Board. After being denied at the Board, they call me in desperation. Unfortunately, it is often too late and they’re forced to serve their license suspensions without even a hardship license.

Please don’t wait until the “last minute” to retain a lawyer. I often have clients call me the night before their hearing or sometimes they try to retain me in court. These cases need preparation and if you wait too long we may have to postpone your hearing so that the case is well-prepared.

Why Hire Attorney Brian Simoneau for your Hearing?

I have over 20 years of experience and I have established myself a statewide expert on driver’s license suspension appeals. I’ve represented other lawyers, doctors, police officers, State Troopers, and Judges in these cases. I have handled complex license suspension appeal cases at the Registry, Board of Appeal, in Superior Courts, and even at the Massachusetts Supreme Judicial Court.

I literally wrote the book on practicing before the Board of Appeal. Other lawyers use my publication Obtaining, Losing, & Seeking Reinstatement of Driver’s Licenses to learn how to represent their clients at the Board of Appeal. This is a specialized area of law and the Board is no place for an inexperienced lawyer who does not understand the complexities of the Massachusetts license suspension laws.

How does the Board of Appeal Process Work?

Once I am retained as counsel, I will file your appeal with the Board and I will work closely with you while we are waiting for the Board of Appeal to schedule your case for a hearing. We will prepare your case so that the Board has all of the necessary documentary evidence to issue a favorable decision. Case preparation is critical and I have this down to a science. I will submit a detailed legal memorandum to the RMV Appeal Board which explains exactly why they should overturn your license suspension or grant you a hardship license. Preparation is definitely the key to success.

How do we Start?

Please contact me via phone or e-mail so that we can start the license suspension appeal process. I start by reviewing your driving record and some background information. The results of that review will determine the next steps in the appeal process. Call, text, or e-mail me so that I can review your situation.
