Hardship License Appeal Process

Whether your license is suspended for speeding, surchargable events, DUI (Drunk Driving), drug offenses, being a Habitual Traffic Offender, JOL violations, an immediate threat complaint, medical issue, or any other reason, License Suspension Lawyers have a streamlined and effective representation process. The first step in a hardship appeal that a Suspended License Lawyer will take is to thoroughly review the facts and circumstances of your case. This review almost always includes a detailed analysis of your Massachusetts Driving History and criminal record. With your assistance, we can usually obtain these documents fairly quickly. An in-depth and detailed client interview will be conducted, where you will be asked to provide specific information regarding your history, background, situation, and license suspension case.

After thoroughly reviewing and analyzing your client interview report, records, and sometimes police or medical reports, a determination will be made regarding whether it is advisable to go before the Registry of Motor Vehicles or the Board of Appeal. Sometimes, a RMV lawyer will advise you that you have not served enough of your license suspension and you must serve additional time before trying to get a hearing for a work driver’s license or hardship license. If you apply too early, you run the risk of the Board of Appeal turning you down without giving you a re-apply date.

Next, if a decision is made to go before the Board of Appeal, the lawyer assigned to your case will file the appeal on your behalf. Usually, no advance filing is needed for RMV cases. While the appeal is pending, the attorney will provide you with a list of documents that you will need for the hearing. These documents usually include a letter from your employer, a letter from you (which we will help you write), proof of the lack of availability of public transportation, certain court paperwork and, for certain cases, paperwork related to alcohol / substance abuse treatment. If you are on or have recently completed probation or parole, a letter from your probation or parole officer should also be supplied. In addition to these generic documents, there are usually some case-specific documents that you will need. A Suspended License Lawyer will advise you regarding these items and help you assemble all of the requested material. Before your Hardship License Hearing, your attorney will thoroughly review your file and go over exactly what to expect at the hearing. Clients who are un-represented are usually extremely nervous and may make ineffective presentations. At the hardship appeal hearing, your Registry Attorney will file certain documentary evidence and present your case. We know what information the decision-makers consider and we make sure they have it. Clients may have to answer a few simple questions, but generally do not have to say much. Our clients are usually much more comfortable and confident, as compared to those who do not have proper legal representation.

Once you have had your Board of Appeal Hearing, unless the Board grants you a “re-apply” date, it is very difficult to win a superior court appeal of a hardship license denial. This is because the granting of a hardship license is considered extraordinary relief and courts have ruled repeatedly that holding a driver’s license is a privilege and not a right. The Appeals Board has complete discretion when it comes to hardship licenses and there is certainly no guarantee that the Board will exercise its discretion in your favor. It is for this reason that you should contact a lawyer if you are serious about getting your license reinstated. I often receive desperate calls from clients who have made the mistake of appearing before the Board of Appeal without a lawyer. They call after they represented themselves and lost. In these cases, unless the Board grants a new hearing, there is usually little that I can do.
