Intoxalock – Failed Rolling Re-Tests

If you have an Intoxalock Ignition Interlock Device in Massachusetts and you experience a failed rolling re-test, that means that you took a breath test while the engine was running and your BAC was above .02. These failed tests may result in a Violation 2 or Violation 47 on your Intoxalock IID.

Intoxalock refers to rolling re-tests as random tests because they are requested at random intervals. The purpose of these tests is to ensure that the driver did not consume alcohol while driving or have a sober person start his or her vehicle because they were under the influence of alcohol.

If you have 2 failed rolling re-tests within a service period with a reading below .05, the Registry may suspend your driver’s license for 10-years.

If you have 1 failed rolling re-test at or above .05, you are at risk for a 10-year license suspension.

Failed rolling re-tests occur when the vehicle’s engine is running or the Intoxalock ignition interlock device initiated a rolling re-test while the engine was running, if the engine is turned off before the breath sample is provided. The vehicle does not have to be “rolling” or in motion for a failed rolling re-test to occur.

If you are an Intoxalock customer and you experience a failed rolling re-test that was not caused by consumed alcoholic beverages, you should immediately go to the nearest police station or Massachusetts State Police Barracks and request a comparison breath test. You should also contact Intoxalock and report the false positive reading. Make note of the facts and circumstances surrounding the failed Intoxalock test.

One of the best ways to avoid failed rolling re-tests is to avoid eating or drinking anything but water while you are driving. Also, be careful with products that contain any type of alcohol, which may result in false positive Intoxalock readings.

You have 30 days to contest a lockout, and you can do this on the Registry’s website.
