New York Conditional Licenses

Out of State Issues

If you are a Massachusetts Resident or License Holder, the Registry of Motor Vehicles will penalize you for a New York DWI or DWAI conviction, just as if the offense had occurred here in Massachusetts. Furthermore, if the New York Department of Motor Vehicles (DMV) has suspended your driving privileges or right to operate in New York, the Massachusetts RMV will automatically impose a reciprocal indefinite AMVA Withdrawal here in Massachusetts.

However, I may be able to get you back on the road here in Massachusetts if you can obtain a Conditional NY License or conditional driving privileges.

For those facing DUI license suspensions in the State of New York, the NY Department of Motor Vehicles offers Conditional Licenses and Conditional Driving Privileges, which allow the holder to drive to and from various places, such as the license or privilege holder’s place of employment, classes, medical appointments, the New York Impaired Driver Program, and other similar locations.
The New York Conditional License is the NY equivalent of the Massachusetts Hardship License, although in Massachusetts, hardship licenses holders can drive anywhere and they are not limited to using the hardship license just to get to and from work, school, alcohol programs, or medical appointments. The issuance of these licenses is overseen by the NY DMV Driver Improvement Unit in Albany, NY.

It may be possible to get the Massachusetts Registry of Motor Vehicles to recognize a Conditional NY License or conditional NY driving privileges by appealing the Massachusetts license suspension, as I have successfully done in prior cases. I have obtained orders which require the Mass. RMV to recognize out of state hardship licenses and conditional permits, so that the Mass. License holder can reinstate his or her license.

These conditional license reinstatements are restricted to Class D licenses and they do not apply to Commercial Driver’s Licenses.
